Banning political parties altogether is pretty much impossible. How do you define a political party? Wikipedia says: "A political party is a group of people who come together to contest elections and hold power in the government." You can't make groups of people illegal. You can't make friendship between people of similar views illegal.

Yup. Factions are inevitable, but Madison (and the rest of them, really) were more concerned with an imbalance of power, extremism, and a breakdown of communication between factions.

Imbalance of Power

Supermajorities were set up that way because no one expected them to be a common thing. Congress was supposed to function through compromise, and through by and large party-line votes, with a handful of votes from "defectors." This would encourage consensus legislation that benefited the nation over the party.


Factionalism was inevitable, but it was hoped that the populace would act as a moderating influence on their parties, so as to continue the spirit of bipartisan consensus that ratified the Constitution in the first place. Parties that diverged to an extreme degree would have been a major problem, as this would not only deadlock the government, but also lead to some group being unrepresented by the shifting parties.

Breakdown of Communication

A natural result of extremism, a breakdown of communication between the parties would lead to virtually no consensus in government, as well as encouraging voters to elect a large bulk of Representatives from one party only, and to not view candidates by their policy, as they should have. This would lead to an imbalance of power in the Federal Government, and would encourage partisan legislation that benefited the party over the nation, something very much not in the spirit of '87.

Americans can understand blue vs. red, idk if we as a whole would be willing to try to understand much more.

If a third party were to come up it would draw support away from the party most similar to it. You see this with the Green Party and the Democratic Party. Most people who would vote for Green Party candidates are left leaning environmentalists. They are far closer on the political spectrum to the Democrats than the Republicans. Suppose the Green Party where to get 30% of the vote in the next presidential election. If this happened it's likely because a massive amount of Democrats defected to vote Green because there are currently very few left leaning environmentalists in the Republican Party. The result of this election may likely be 45% Republican 30% Green and 25% Democratic. In this reality most people would have voted for a left wing party with pro environmentalist policies but it's the right wing party without pro environmentalist policies which would win the election.

This is why Republican governors and secretaries of state will fight tooth and nail to try to prevent Libertarians from getting ballot access. Libertarians draw more from the Republican side than the Democratic side and thus when someone defects to vote Libertarian they are likely hurting the GOP and helping the Democrats. If you want to advance your policies you basically have to join one of the two major parties. If we established ranked choice voting or a Parliamentarian system this might change.

I believe the House was originally direct elections but senators were not. Your state legislature selected your senators with the idea being that those in the Senate would be more senior and have already served in government and thus could temper and/or guide the ideas put forth by the younger & popularly elected House.


Where in the Constitution does it state it was set up as an ethno-state. If that were true, I think it would have been explicitly laid out as such.
