Trump Discloses Payment to Cohen in Financial Report

I am copying the former Director of the United States Office of Government Ethics, Walter Shaub's (@waltshaub) comments here:

Donald Trump's financial disclosure report has been released and discloses the debt to Cohen that was not reported in last year's report.

On the cover page, OGE disagrees with Trump's claim that the debt is not reportable but indicates that all required information is included in this report. That means that the information was required to be reported last year.

In turn, that means that Trump committed a crime if the omission was "knowing and willful." Trump may be wondering today whether the information DOJ seized from Cohen's office included any emails or other documents showing he knew of the debt when he filed last year's report.

It's not clear whether the courts will let DOJ use the information is seized. Still, it may have some people feeling nervous today.

Remember, Giuliani said earlier this month that Trump paid Cohen a lot more than the $130,000. He said between between $460k and 470k. If that's true, this could be an underreporting.

In the interest of transparency, while not required to be disclosed as ‘reportable liabilities’ in 2016 expenses were incurred by one of Donald J. Trump's attorneys, Michael Cohen. Mr. Cohen sought reimbursement of those expenses and Mr.Trump fully reimbursed Mr.Cohen in 2017.

I didn't realize being a year late in disclosing this only because the news got out is considered to be transparent.

The hotel is one of his best performing properties, and the disclosure listed revenues of $40.4 million.

And Mr. Trump’s Mar-a-Lago resort in Florida, which has become known as the Winter White House, saw revenues of $25.1 million..


Other properties have not fared as well, including Trump National Doral, a golf resort near Miami, which is Mr. Trump’s biggest cash flow generator. It reported revenue of $74.8 million. Revenue there had tumbled in the filing a year ago, even after a major renovation.

Some time after the campaign is over, they set up a reimbursement, $35,000 a month, out of his personal family account,” Mr. Giuliani said. He added that over all, Mr. Cohen was paid $460,000 or $470,000 from Mr. Trump through those payments

He's one of the least loyal people in the world and he can't pardon everyone.

Donald trump also own a 4% stake in a company called Starrett City Associates.

This companies background is hilarious.

The firm is best known for unsuccessfully defending a landmark civil rights lawsuit that concerned "reverse discrimination" and racial quotas in the housing complex, and for controversy during the sale of the development in the mid-2000s.[1]

In 1980, the NAACP initiated a class-action suit against Starrett City Associates and charged that the owner of the housing complex attempted to maintain racial quotas by selective approval of tenants based on racial and ethnic profiles. The quotas caused minority applicants to wait longer than white applicants for spaces in the complex. Starrett City Associates argued that the quotas were necessary to maintain racial balance. In other words, if the quotas had not been in place, the population would have been disproportionately non-white.

In 1990, Starrett proposed to make apartments available to Soviet Jews who came to the United States in order to "keep the development racially and ethnically integrated," in the words of a spokesperson (The New York Times, 24 July 1990).

I hate to be so cynical but can't he just use the same old Trump family excuse of "I'm new to this, I forgot, I didn't recall, etc?" I mean, Jared has spent two years trying to fill out a top secret clearance application, repeatedly amending it after 'forgetting' to include required financial and personal disclosures.

But that's what the Schaub tweets are about - if documents show that Trump did know he should report but directed that these payments should not be reported, then it is a crime because the omission was knowing and willful.

Treason may have a specific legal definition, but it appears that a large number of Republicans have conspired to act against the United States with the aid of one or more foreign governments in order to line their own pockets, and this has been done at the measurable expense of Americans. And even if they started off with 'normal' corruption, at some point they knew what they were involved in and instead of standing up, they covered up.

I believe many people involved need to hang, and Trump's just the front man in this mess, not the ring leader. And I mean hang. Jail sentences are not graphic enough to result in a cultural change that makes their actions unthinkable to the next group to come along.

I remember when it was "I don't know anything about the payment. You'll have to speak with my lawyer Michael Cohen."

Even if Fox News was obliterated there would be new "media" rising from their ashes. I'm really losing faith in our ability to think critically as a nation. The green fees at the start of 2017 will jump to $450 per round, at least through April 30. That fee includes carts and taxes, but it doesn't include the mandatory forecaddie (or better) that you are required to have. At a minimum the forecaddie costs $25 per player with a recommended $20 gratuity. You can get a premium forecaddie for $75 per player. Double-bag caddies run the same rate, while a single-bag caddie goes for $125 for the round.

That green fee may be a little steep. There are three other courses -- Red, Gold and Silver -- to choose from, all of which aren't exactly cheap either. The Red and Gold courses cost $250 per round, with the Silver course green fee at $195.

Staying at Trump Doral as a hotel guest, however, isn't particularly outrageous. Rates for a Deluxe Room with a king bed in a 343-square-foot room start at $170 per night. A Premier Suite runs about $400 per night. The Presidential Suite, though? That's about $6,000 per night -- and, at that point, the Blue Monster green fee is nothing on your wallet.

Keep in mind that 74.8 million is revenue, not profit. And all those numbers from the article don't include whatever else they sell like party/wedding bookings. They probably have members fees. There's probably licensing deals like if Tiger Woods Golf game wants to use that name/course, that's going to cost a lot of money.

Now donald just has to get as much foreign labor as possible to maximize profit.

No disagreement with that but this piece of public information is the first time that any government institution beyond the DoJ (special counsel and FBI) have found something concrete, in which to openly cooperate with the DoJ. That's what's been missing, considering how the two branches of Congress controlled by the GOP, have been actively enabling Trump. Thankfully, we're also hearing today from the Senate Intelligence Committee that they disagree with Nunes' findings but what concrete actions they'll be taking is uncertain.

Trump says a lot of things, most of which he doesn't recognize when asked later

Cohen paid off Daniels $130k to keep quiet about an affair between her and Trump when Melania was pregnant.

Daniels feels that Cohen broke his part of the deal, so she spoke up about it and hired a lawyer.

This is where it splits into several interesting tracks:

Track 1:

Daneil's lawyer discovered that the payment made to her came fro ma shell company that was getting suspiciously large amounts of money from companies, that looked an awful lot like bribes.

The companies have corroborated this, and say that Cohen came to them soliciting bribes. The companies have also mostly stated that Robert Mueller had already talked to them about these bribes.

Track 2:

Whether or not Cohen's reasoning for paying of Daniels is related to the fact that Trump was running for President at the time is a sticking pint - if he was, it is a material campaign contribution but was not claimed as such. This is a FEC violation IF it was motivated by being in defense of the campaign.

Track 3:

Trump has repeatedly denied any knowledge of the payments from Cohen to Daniels, and says that he never paid Cohen back for that, that he just pays Cohen a retainer to take care of problems as they come up.

This document, whoever, shows that he explicitly paid Cohen back for this, which chows that he did indeed have knowledge of the payment... and failed to disclose it until now. Which would be a felony.


Trump just admitted a lie, admitted a felony-level FEC rules violation, admitted a second felony (lying on a financial disclosure), and did so in an official document.

History better pillory this era.
