Trump Discloses Payment to Cohen in Financial Report

Trump Discloses Payment to Cohen in Financial Report

I am copying the former Director of the United States Office of Government Ethics, Walter Shaub's (@waltshaub) comments here:

Donald Trump's financial disclosure report has been released and discloses the debt to Cohen that was not reported in last year's report.

On the cover page, OGE disagrees with Trump's claim that the debt is not reportable but indicates that all required information is included in this report. That means that the information was required to be reported last year.

In turn, that means that Trump committed a crime if the omission was "knowing and willful." Trump may be wondering today whether the information DOJ seized from Cohen's office included any emails or other documents showing he knew of the debt when he filed last year's report.

It's not clear whether the courts will let DOJ use the information is seized. Still, it may have some people feeling nervous today.

EDIT

More comments from Shaub:

The strangest moment in my entire career was when Trump's attorney, Sheri Dillon, asked me to allow Trump's financial disclosure form to be the first out of all of the millions filed not to contain the filer's certification that its contents were true

Did Trump's request not to have to certify that his financial disclosure report constitute evidence of his consciousness of guilt with respect to the debt to Cohen for the Stormy Daniels payment?

And a link to an article from a year ago.

https://twitter.com/AriMelber/status/996805188232065024

NEW: Ethics office sending letter to Rod Rosenstein stating that Michael Cohen's payment on behalf of Trump was a debt and may be relevant to "any inquiry" Rosenstein may be pursuing.

OGE: Yeah, this shit looks shady...

Ok, so then that is his contract. The one he didn't sign. And now he's on record with the payoff.

Remember, Giuliani said earlier this month that Trump paid Cohen a lot more than the $130,000. He said between between $460k and 470k. If that's true, this could be an underreporting.

Trump is so corrupt that even the lackeys that he appoints all over the place are throwing their hands up.

He also just tweeted this:

This is tantamount to a criminal referral. OGE has effectively reported the president to DOJ for potentially committing a crime. Dave Apol comes through in the end!!

Edit: link to tweet

Footnote from page 45 of the pdf:

In the interest of transparency, while not required to be disclosed as ‘reportable liabilities’ in 2016 expenses were incurred by one of Donald J. Trump's attorneys, Michael Cohen. Mr. Cohen sought reimbursement of those expenses and Mr.Trump fully reimbursed Mr.Cohen in 2017.

I didn't realize being a year late in disclosing this only because the news got out is considered to be transparent.

Also:

The category of value would be $100,000-$250,000 and the interest rate would be zero.

Hmm, sounds familiar I think

Still, the disclosure provides the first extended look at the performance of Mr. Trump’s Washington hotel, which opened in September 2016 and has become a magnet for lobbyists and Republican aides. The hotel is one of his best performing properties, and the disclosure listed revenues of $40.4 million.

And Mr. Trump’s Mar-a-Lago resort in Florida, which has become known as the Winter White House, saw revenues of $25.1 million..

...

Other properties have not fared as well, including Trump National Doral, a golf resort near Miami, which is Mr. Trump’s biggest cash flow generator. It reported revenue of $74.8 million. Revenue there had tumbled in the filing a year ago, even after a major renovation.

President Swamp Thing!!!

So he lied about not knowing about an affair that he claims didn't happen and then paying off the accuser. 😵

This is the big part. The Office of Governmental Ethics is treating it as felony campaign finance fraud.

The trouble is Congress. Vote the republicans out

'I'm the ONLY candidate who is self funding! I am the pinnacle of ethics!'

Fucking traitor.

They don't want to get taken down with him

This is a very important point. He almost certainly underreported, and there may be a long line of those he paid off ready to come forward.

The goalposts are moving.

From the disclosure:

The category of value would be $100,001 - $250,000 and the interest rate would be zero."

This contradicts what Giuliani said on live television two weeks ago:

Some time after the campaign is over, they set up a reimbursement, $35,000 a month, out of his personal family account,” Mr. Giuliani said. He added that over all, Mr. Cohen was paid $460,000 or $470,000 from Mr. Trump through those payments

He's one of the least loyal people in the world and he can't pardon everyone.

Damn straight people don't want to be involved in any of his bullshit.

Isn't this precisely what the Emoluments Clause is meant to prevent?

It's like how they were lauding Don Jr. for his transparency over the Trump Tower meeting even though he had just spent the entire weekend lying about it and covering it up.

Is the trouble here with filing taxes or campaign finance?

He paid money to his lawyer who unilaterally paid money to a porn star for an affair that they claim didn't happen because...the best negotiator?

Only if you have a D beside your name, or you own a peanut farm.

Oh boy. So this is where it officially begins.

TL;DR:

Trump might now be willing to throw Cohen under the bus, in order to try and save himself.

Donald trump also own a 4% stake in a company called Starrett City Associates.

This companies background is hilarious.

https://en.wikipedia.org/wiki/Starrett_City_Associates

The firm is best known for unsuccessfully defending a landmark civil rights lawsuit that concerned "reverse discrimination" and racial quotas in the housing complex, and for controversy during the sale of the development in the mid-2000s.[1]

In 1980, the NAACP initiated a class-action suit against Starrett City Associates and charged that the owner of the housing complex attempted to maintain racial quotas by selective approval of tenants based on racial and ethnic profiles. The quotas caused minority applicants to wait longer than white applicants for spaces in the complex. Starrett City Associates argued that the quotas were necessary to maintain racial balance. In other words, if the quotas had not been in place, the population would have been disproportionately non-white.

In 1990, Starrett proposed to make apartments available to Soviet Jews who came to the United States in order to "keep the development racially and ethnically integrated," in the words of a spokesperson (The New York Times, 24 July 1990).

Trump committed a crime

Gonna need you to go ahead and throw that on the pile. We'll get to it as soon as we can. The backlog is ridiculous.

I can’t wait to see how history books treat this circus.

The answer is, all three.

The goalposts have been thrown under the bus.

And, obviously, the LLC pass-through method is a great end-around for the purposes of disclosure, specifically what Trump is legally obligated to disclose as the fucking president of the country. The idea that you could just dismiss that as politics/business as usual makes you automatically someone who cannot be taken seriously. And you are obviously intellectually dishonest to your core.

But, remember, nothing matters anymore anyway. Drain the swamp, and MAGA.

Better start learning Mandarin.

Wonder what will be left out of this.

Honestly, what is up with this week? Why is this all happening on the same week as mueler’s appointment anniversary.

Surely, Grassley already had the transcripts ready to be released ages ago for one.

Are we going to get the rest of the IG’s report this week that we were suppose to get awhile ago? Is it going to have politically charged release?

Imagine being Cohen right now depending on Trump's loyalty, knowing (probably ten times as well as we do) how disloyal he is to his cellular core.

Same goes for Manafucked and Flynn and Gates, to a lesser extent. They know he'd fuck them, without blinking, the nanosecond it benefited him to do so.

Lying to the press isn't a crime. Lying on the form is. I can't wait to find out the real truth.

I don't think that Manafort is being offered a chance to flip. He is a dirty fucking traitor who is probably responsible for thousands of deaths around the world. If anyone currently charged doesn't deserve a deal, it is this guy. If Mueller has him dead-to-rights (and it sure looks that way) than I can see why he might not qualify for a deal of any kind. This guy needs to hang.

I'm pretty sure Ivanka can....

Walter Shaub adds to this

This is tantamount to a criminal referral. OGE has effectively reported the president to DOJ for potentially committing a crime. Dave Apol comes through in the end!!

I hate to be so cynical but can't he just use the same old Trump family excuse of "I'm new to this, I forgot, I didn't recall, etc?" I mean, Jared has spent two years trying to fill out a top secret clearance application, repeatedly amending it after 'forgetting' to include required financial and personal disclosures.

Which is why Flynn and Gates flipped. I think Manafort is afraid he will fall out of a 14th floor window if he flips. He knows how the Russians work. Better to be alive in prison then dead on the pavement.

But that's what the Schaub tweets are about - if documents show that Trump did know he should report but directed that these payments should not be reported, then it is a crime because the omission was knowing and willful.

Didn't he explicitly say he was not aware of the payment?

Also, Fuck Me and Ajit Pai. ^

The WH has flip flopped like 3 times now on whether or not Trump paid Cohen back.

This guy needs to hang

Treason may have a specific legal definition, but it appears that a large number of Republicans have conspired to act against the United States with the aid of one or more foreign governments in order to line their own pockets, and this has been done at the measurable expense of Americans. And even if they started off with 'normal' corruption, at some point they knew what they were involved in and instead of standing up, they covered up.

I believe many people involved need to hang, and Trump's just the front man in this mess, not the ring leader. And I mean hang. Jail sentences are not graphic enough to result in a cultural change that makes their actions unthinkable to the next group to come along.

Remember when the goalposts were "absolutely no contacts with any russians"? Those were good times

Cohen better grab him by the cankles.

Well ya but only on camera. How could you ever hold him to that?

It ain't that big.

Campaign Finance: Absolutely, he just admitted to a Felony violation of campaign finance law..

Taxes: Unknown, we won't know until he releases his taxes, like he promised to two years ago.

Let's not overlook this little gem:

Still, the disclosure provides the first extended look at the performance of Mr. Trump’s Washington hotel, which opened in September 2016 and has become a magnet for lobbyists and Republican aides. The hotel is one of his best performing properties, and the disclosure listed revenues of $40.4 million.

His DC hotel is killing it. Huh.

It's been real. Now we have very VERY public information showing how real it is for yet ANOTHER crime.

:gags:

Traitor is a more than appropriate way to describe this man, I could go on for hours but I hope he is remembered this way, always.

Can we drain him?

Looking forward to the Avenatti take on this. Dude is on point.

asked me to allow Trump's financial disclosure ... not to contain the filer's certification that its contents were true

Why would that even be allowed? Is there a loophole where you can just say you had your fingers crossed when you wrote it as well?

Trump has, by far, had the most transparent administration in history!...and by that they mean they've had the most transparent lies in history.

I saw this coming the moment that asshole idiot entered the race.

You can all feel free to praise my incredible insight now. You can tell I'm a very stable genius by how I just said those words in that order.

Based on the what we've seen of Cohen's sloppy LLC setup and the quality of his NDA's, I think there's hope that Donnie left a paper trail a mile wide.

The Russians won't come out on top in all this. They'd need complete political and social reform. As it is, they are only a major player in the sense that they cause disorder and chaos; they simply lack the physical infrastructure and reliable economic order required to ever be a rising force. China, by comparison, actually has some interest in internal growth and forward thinking; Russia's leadership is far more interested in padding the pockets of its powerful elites, which ultimately will ensure it stagnates in the long run (just like the GOP's greed is setting back America).

And Mr. Trump’s Mar-a-Lago resort in Florida, which has become known as the Winter White House, saw revenues of $25.1 million

Just because you call your place that doesn't mean everyone does, T-Bone.

Even with all of that, there's still one thing lacking: a Congress that's willing to act.

Watch out for the bone spurs!

But wasn't Giuliani recently saying the reimbursement was $470k? Is that the fact that he had to "get straight"?

Just throw it into the Mueller pile over there

The bar is in that bag in the Mariana trench

It kinda has the feel of the endgame in a game of chess where one guy is pretty much in constant check and he is just moving his king around trying to avoid checkmate.

The bar is essentially flush with the floor.

But guys, he's giving up his $400k per year salary. That totally offsets all of this.

WHOAH, shit's finally getting real!!!!

This Giuliani arc is going to just doom the main character, isn't it?

"It's an attack on our country"

Trump's level of panic ("Attorney-client privilege is dead!", ) during the Cohen raid leads me to believe that there's something of value that ended up being recovered.

I honestly think they're stupid enough to have banked on using attorney-client privilege to keep important things private

As part of a voluntary ethics plan, the Trump Organization has not pursued new deals in foreign countries, cutting off an important stream of business that was projected to provide much of its future revenue. The Trump Organization is also subjecting all new domestic projects to vetting from an outside ethics adviser, which appears to have had a chilling effect on certain potential deals: the company has yet to open a new hotel in the United States since Mr. Trump took office.

Well that's bollocks. China is contributing $500 million to Trump-linked project in Indonesia

If it's the same as the OGE-450 form the issue is one of knowingly providing false information rather than the legality of the asset/liability itself.

It could be a perfectly legal liability but knowingly failing to report is the crime itself.

Well that's enough internet for today.

Sure, but the solution is to focus on Congress.

yes but that was like weeks ago, we can't be expected to care about that anymore

Short-term, yes, we have to focus on the midterms. But the way Republicans are protecting Trump is essentially treasonous, even if it doesn't meet the specific definition. Faux News and the whole GOP leadership need to be eviscerated by the media and the courts.

Don't worry, there's always time to hate Ollie North.

Information overload in the hopes we just shrug at it? I dunno.

we can't get enough white people in to keep the place white so the only non-blacks they could find were soviet jews?

Oh, that's a given. And Trump's non-stop conniption fits about the investigation, after Cohen got raided, etc., prove it. He knows he's dead to rights, and the only defense he has it to kill the investigation. That's his ONLY exit ramp for this.

AKA, Mount Doom.

Mandarussian.

Maybe there's a big story coming out this week and this is the distraction?

What am I saying, there's big story coming out every week.

I remember when it was "I don't know anything about the payment. You'll have to speak with my lawyer Michael Cohen."

Even if Fox News was obliterated there would be new "media" rising from their ashes. I'm really losing faith in our ability to think critically as a nation. If it's not political thought, it's anti-science thought especially within the medical industry. I really fear the rise of fascism as a result.

https://thegolfnewsnet.com/golfnewsnetteam/2016/11/04/how-much-cost-play-golf-trump-doral-blue-mo...

The green fees at the start of 2017 will jump to $450 per round, at least through April 30. That fee includes carts and taxes, but it doesn't include the mandatory forecaddie (or better) that you are required to have. At a minimum the forecaddie costs $25 per player with a recommended $20 gratuity. You can get a premium forecaddie for $75 per player. Double-bag caddies run the same rate, while a single-bag caddie goes for $125 for the round.

That green fee may be a little steep. There are three other courses -- Red, Gold and Silver -- to choose from, all of which aren't exactly cheap either. The Red and Gold courses cost $250 per round, with the Silver course green fee at $195.

Staying at Trump Doral as a hotel guest, however, isn't particularly outrageous. Rates for a Deluxe Room with a king bed in a 343-square-foot room start at $170 per night. A Premier Suite runs about $400 per night. The Presidential Suite, though? That's about $6,000 per night -- and, at that point, the Blue Monster green fee is nothing on your wallet.

Keep in mind that 74.8 million is revenue, not profit. And all those numbers from the article don't include whatever else they sell like party/wedding bookings. They probably have members fees. There's probably licensing deals like if Tiger Woods Golf game wants to use that name/course, that's going to cost a lot of money.

Now donald just has to get as much foreign labor as possible to maximize profit.

No disagreement with that but this piece of public information is the first time that any government institution beyond the DoJ (special counsel and FBI) have found something concrete, in which to openly cooperate with the DoJ. That's what's been missing, considering how the two branches of Congress controlled by the GOP, have been actively enabling Trump. Thankfully, we're also hearing today from the Senate Intelligence Committee that they disagree with Nunes' findings but what concrete actions they'll be taking is uncertain.

By going there with a huge entourage almost every week?

I feel like he will be, but we know it won't matter for half the country.

I honestly think he could be caught on tape conspiring with Putin to suppress votes in specific counties in Ohio, Wisconsin, etc, and nobody in his base would give a flying fuck.

They just don't care, because they don't care about their country and actively hate themselves, minorities, non christians, poor people, disabled people... EVERYBODY who is not a white, christian, affluent Trump supporter. And then if you're a woman and all those things, they're definitely looking down on you as a person.

he's on (phone) msnbc right now

I feel like it should be considered fraud.

Like, Trump was elected based off a ton of lies. If I get a bunch of people to invest in my company and it turns out that everything I said was bullshit and that I knew it was bullshit, I can get into a lot of trouble.

Could you imagine if he just blanket pardoned every American, opened up Rikers and Guantanamo, and then made his escape to Russia during the Purge-esque chaos?

It'd be a hell of an ending.

Seems Rudi is smarter than Trump. Nobody believes Daniels was the only one paid off. Eventually he'll Mend the form again when the other payments are confirmed.

Trump says a lot of things, most of which he doesn't recognize when asked later

Cohen paid off Daniels $130k to keep quiet about an affair between her and Trump when Melania was pregnant.

Daniels feels that Cohen broke his part of the deal, so she spoke up about it and hired a lawyer.

This is where it splits into several interesting tracks:

Track 1:

Daneil's lawyer discovered that the payment made to her came fro ma shell company that was getting suspiciously large amounts of money from companies, that looked an awful lot like bribes.

The companies have corroborated this, and say that Cohen came to them soliciting bribes. The companies have also mostly stated that Robert Mueller had already talked to them about these bribes.

Track 2:

Whether or not Cohen's reasoning for paying of Daniels is related to the fact that Trump was running for President at the time is a sticking pint - if he was, it is a material campaign contribution but was not claimed as such. This is a FEC violation IF it was motivated by being in defense of the campaign.

Track 3:

Trump has repeatedly denied any knowledge of the payments from Cohen to Daniels, and says that he never paid Cohen back for that, that he just pays Cohen a retainer to take care of problems as they come up.

This document, whoever, shows that he explicitly paid Cohen back for this, which chows that he did indeed have knowledge of the payment... and failed to disclose it until now. Which would be a felony.

TLDR

Trump just admitted a lie, admitted a felony-level FEC rules violation, admitted a second felony (lying on a financial disclosure), and did so in an official document.

History better pillory this era.

It's fucking disgusting.

Holy shit. How am I supposed to get any work done today? Bombs dropping left and right.
